GENERAL CONDITIONS OF SALE

PREAMBLE

Welcome to the GEOART online store. These conditions of sale are concluded on the one hand by the company GEOART, registered in the Trade and Companies Register of Papeete under number 20 2943 A, hereinafter referred to as "GEOART" and managing the site www.geoartmap.com and, on the other hand, by any natural person wishing to make a purchase via the website www.geoartmap.com hereinafter referred to as "the buyer".

ARTICLE 1: OBJECT

These conditions of sale aim to define the contractual relationship between GEOART and the buyer for any purchase made through the website www.geoartmap.com. The acquisition of a product through this site implies unreserved acceptance by the buyer of these general conditions of sale, of which the buyer acknowledges having read prior to his order.

GEOART retains the possibility of modifying these conditions of sale at any time, in order to comply with any new regulations or with the aim of improving the use of its site. Therefore, the applicable conditions will be those in force on the date of the order by the buyer.

ARTICLE 2. PRODUCTS

The products offered are those that appear on the GEOART company\'s website www.geoartmap.com.

GEOART reserves the right to modify the product assortment at any time. Each product is presented on the website in the form of a description containing its main technical characteristics (dimensions, material used, etc.). The photographs are as accurate as possible but do not commit GEOART in any way. The sale of the products presented on the site www.geoartmap.com is intended for all buyers residing in French Polynesia, Metropolitan France and Overseas (Guadeloupe, Reunion, Mayotte, Martinique, French Guiana, New Caledonia, Wallis -and-Futuna).

ARTICLE 3. PRICES

The prices appearing on the product sheets of the internet catalog are prices in EUROS. GEOART comes under the Basic Excess Regime: VAT is not applicable. The prices are inclusive of VAT for French Polynesia and exclusive of VAT for exports outside Polynesia. GEOART reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery costs, which may be invoiced in addition, depending on the total amount of the order and the place of delivery. Shipping costs are calculated according to the delivery area and according to the total weight of the products ordered, according to the current rates set by the carriers.

Since July 1, 2021, following a new European directive, VAT applies to all imported goods, from a country outside the European Union, and destined for metropolitan France and DOM, in addition to any shipping costs. customs. The buyer will have toleave the payment of customs duties and taxes, and customs clearance costs in order for your shipment to be released to you.

ARTICLE 4. MANUFACTURING TIME

The production time is 5 working days for any item ordered on the site, from the date of payment.

ARTICLE 5. ORDER AND TERMS OF PAYMENT

The buyer can order as a visitor or by creating a customer account. As a visitor, the buyer must still provide basic information in the order validation form (address, telephone number, essential for delivery). GEOART undertakes that the telephone number entered will not be used for commercial prospecting purposes.

GEOART offers the buyer to order and pay for his order with two payment options a choice :

Secure payment by credit card (VISA or MASTERCARD):when the buyer chooses the "Online payment" payment method, he is redirected to the secure interface in order to enter his personal bank card details. If the payment is accepted, the order is recorded and the contract definitively formed. Payment by credit card is irrevocable. In case of fraudulent use of it, the buyer may demand the cancellation of the payment by card, the sums paid will then be credited or returned. Payments on the GEOART store are completely secure via the Payplug payment system. You can therefore make your purchases as on any international site, in complete safety.

Cash payment on Tahiti: the buyer can pay for his goods by cash (cash), on Faa\'a. A meeting place will be agreed after the order is placed on the site.

The confirmation of an order entails acceptance of these conditions of sale, the recognition of having perfect knowledge of them and the renunciation of availing oneself of its own conditions of purchase. All the data provided and the recorded confirmation will constitute proof of the transaction. GEOART will communicate to the buyer by e-mail the confirmation of the registration of his order. ARTICLE 6. SECURITY OF PAYMENTS

The GEOART company uses the Payplug system. The data is encrypted. No third party has access to confidential payment information. In any case and following a payment on www.geoartmap.com, GEOART does not keep or collect the confidential banking data of customers. The credit/debit card number is never stored.

ARTICLE 7. DELIVERY

Orders placed on www.geoartmap.com are delivered to French Polynesia, metropolitan France and overseas (Guadeloupe, Reunion, Mayotte, Martinique, French Guyana, New Caledonia, Wallis and Futuna). GEOART offers the buyer different possibilities to receive his products purchased online:

- Tahiti: possibility of agreeing on a pick-up location in Faa\'a to pick up your order.

Postal delivery in French Polynesia: postal shipments are made by the Polynesian Post Office (OPT) to the address indicated in the form (Post Office). Orders are sent by parcel.

- Postal delivery in metropolitan France or overseas : parcels are sent by the Polynesian Post Office (OPT) to the address indicated in the form. Two options are available for shipping parcels: priority shipping or Chronopost.

The risks associated with transport are the responsibility of the purchaser from the moment the items leave GEOART\'s premises. The buyer is required to check the condition of the packaging of the goods and its contents upon withdrawal. In the event of damage during transport, any protest must be made to the OPT or La Poste.

ARTICLE 8. RETRACTATION

Under Article L121-20 of the Consumer Code, the buyer has a period of fourteen days from receipt of his order to exercise his right of withdrawal and thus return the product to the seller for reimbursement. without penalty, with the exception of the cost of return. This right of withdrawal can only apply to a product that remains identical to that of its shipment (new, unused, undamaged condition), with the original packaging. Otherwise, GEOART will not be able to apply the right of withdrawal, any product returned worn, damaged or incomplete will not be taken back. The refund of the product is then made within 7 days of the date of receipt.

ARTICLE 9. INTELLECTUAL PROPERTY

All elements of the GEOART site are and remain the exclusive intellectual property of the GEOART company. As such and in accordance with the provisions of the intellectual property code, no one is authorized to reproduce, exploit, or use for any reason whatsoever, even partially, elements of the site.www.geoartmap.com. Any use of the GEOART name or elements of the site, even partial ones, may give rise to legal action and penalties for the violation of intellectual property rights.

 ARTICLE 10: FORCE MAJEURE

The performance of the seller\'s obligations hereunder is suspended in the event of the occurrence of a fortuitous event or force majeure which would prevent its performance. The seller will notify the customer of the occurrence of such an event as soon as possible.

 ARTICLE 11. TRIBUNAL COMPETENT

Any dispute relating to the interpretation and execution of these general conditions of sale is subject to French law. Failing amicable resolution, the dispute will be brought before the Commercial Court of Papeete.
